LICITAÇÃO PÚBLICA: AS CONTRATAÇÕES DIRETAS ANALISADAS SOB A PERSPECTIVA DO INTERESSE PÚBLICO
Abstract
Muito embora as contratações diretas estarem previstas na legislação elas são vistas como sendo procedimentos eivados de ilegalidade e imoralidade pelos órgãos de controle o que gera constantes medo na atuação do administrador público. A própria Constituição Federal que dispõe como regra o dever de licitar, também faz ressalva quanto a possibilidade de contratação direta na qual é dispensada a licitação, ou seja, a legislação estabelece algumas hipóteses onde a obrigatoriedade em licitar não será aplicada. É o que dispõe o artigo 37, inc. XXI da Constituição Federal. Com base nessas explanações, o presente estudo científico por meio de uma metodologia de pesquisa exploratória, tem como finalidade responder ao seguinte questionamento: "Qual é a importância das contratações diretas para o interesse público?". Para isso, será necessário analisar os procedimentos necessários para a licitação direta e especificamente, analisar a viabilidade das licitações públicas, os critérios utilizados para a contratação direta e quais são as legislações que regulamentam o processo licitatório.
