Abstract

This article addresses the legal aspects regarding the custody of animals at the end of the marriage bond. The concept of family, the inclusion of animals in the family nucleus and the consequences of this when the couple separates, divorces o dissolves the stable union, is covered. Considering issues such as family, guardianship, marital rights and assistance to animals, the study seeks to analyze the omission of the Brazilian legal system in relation to the existence of a law that that protects couples in the process of separation regarding this issue. Given the high rate of cases involving animal custody, the article seeks, through the analysis of these aspects, to promote discussion and proposals for regularizing animal custody, bringing to light the hypothesis of a specific law on the subject.
