ABSTRACT: The aim of this paper is to reinforce the right to education for all, since the Federal Constitution emphasizes that education is a right extended to all. Therefore, everyone has the right to access education. This includes people with Autism Spectrum Disorder (ASD). So inclusive education is not out of the package, it is a right granted. This paper will focus on autism, its right to education and legislation as a field of resistance, its advances and setbacks in education. The methodology developed was characterized in the qualitative approach, since it analyzes education as a right for all, based on the Federal Constitution, the Law of Guidelines and Bases of National Education and on readings of books and articles, with points of view and opinions on the subject. From this perspective we will address the following topics: Education, Legislation and Management; Chaos Analysis: legislation as a field of resistance to alienation; the LDB´s ranciditiess and advances: rights that I working for upholding and struggles that I hoping for and Human Drama in the Society of the spectacle: spectator effect x democratic experiences: the dispute between participation and apathy in the PPP. The topics mentioned above are the Federal Constitution, the Law of Guidelines and Bases of National Education and the Educational Legislation as a powerful tool for resisting alienation, providing support for the rights that I am working for upholding and the struggles I hoping for, breaking the rancidities and seeking advances for na inclusive, fair and democratic education, with quality and equity for all. The struggle and search for a new time, where laws are respected and enforced for the benefit of all, for the construction of a more humane and egalitarian Society continues through the few remaining who are still opposed to the human drama in the society of the spectacle, who do not just live as mere spectators.
