(IM)POSSIBILIDADE DA CUMULAÇÃO DE PENSÃO POR MORTE NOS CASOS DE MULTIPARENTALIDADE

O presente artigo apresenta uma discussão acerca da (im)possibilidade da concessão de cumulação de pensões por morte no Regime Geral de Previdência Social nos casos de multiparentalidade. Primeiramente, buscou-se abordar os conceitos dos institutos da Parentalidade Socioafetiva e da Multiparentalidade, estudando em seguida o benefício previdenciário denominada pensão por morte e os requisitos necessários para sua concessão. Por derradeiro, tratou-se de analisar os possíveis efeitos derivados do reconhecimento da cumulação da pensão por morte, nos casos de multiparentalidade, no Regime Geral de Previdência Social. Salienta-se que, a pesquisa teve como base doutrinas do Direito de Família e do Direito Previdenciário, bem como, o exame da legislação em vigor e de decisões judiciais acerca do tema.
