OS CONTRATOS DE PLANO DE SAÚDE E OS DIREITOS DO CONSUMIDOR

O presente artigo objetiva fazer uma análise acerca dos contratos de plano de saúde e dos direitos do consumidor quanto ao tema. Para a sua elaboração foi utilizada uma metodologia baseada na análise bibliográfica, através de pesquisas e estudos em doutrinas, em artigos científicos disponíveis na internet, em legislações nacionais, em consolidações em súmulas e posicionamentos jurisprudenciais. Com base nisso, foi possível analisar acerca da evolução do conceito de contrato, especificamente acerca do contrato de adesão, que representa a principal característica dos contratos de planos de saúde. Observar-se-á, que por mais que a legislação também tenha evoluído, a fim de garantir mais proteção ao consumidor, este não se encontra livre de ser vítima de práticas abusivas decorrentes desses contratos. Diante disso, é fundamental que o consumidor conheça seus direitos e esteja atento às cláusulas desses contratos.
