A DIVISÃO DE BENS PERANTE O FIM DA UNIÃO ESTÁVEL

Este estudo teve como objetivo expor as demandas patrimoniais diante do rompimento da união estável e esclarecer possíveis dúvidas dos companheiros envolvidos na mesma. A união estável é uma modalidade familiar antiga semelhante ao casamento e que tem por finalidade constituir família, adquirindo assim direitos e deveres que devem ser seguidos para ser validada. A pesquisa foi desenvolvida por meio de caráter qualitativo, na intenção de analisar de forma mais profunda aspectos intrínsecos desta união e fornecer informações relevantes ao referido tema, se baseando em artigos, livros, monografias e leis presentes no ordenamento jurídico. Como resultado fora encontrado por meio de análises a evolução da união estável ao longo dos anos com a obtenção do seu reconhecimento na sociedade e no regulamento brasileiro, que acabou por gerar mudanças positivas e até mesmo contraditórias para esta instituição familiar. Concluiu-se que em relação à divisão dos bens do casal adeptos desta união o contrato escrito define o modo o qual os bens serão divididos entre as partes.
