This research deals with labor law, more specifically with regard to the characterization criterion of an employment relationship. With the analysis of the terms of use of the application in comparison with the norms of Labor Law, the objective is to evaluate the relationship between the company Uber and the drivers, regarding the existence of this type of relationship. The research brings doctrinal foundations on the subject, as well as the position of the courts.
