ARBITRATION IN INDIVIDUAL LABOR CONTRACTS: OPPORTUNITY OR SEGREGATION?

The article addresses the institution of arbitration in the labor sphere, focusing on its accessibility and legal security. This institute has debatable applicability in individual employment contracts, which is why the legal changes that are currently taking place and the acceptance of this method as an efficient option for resolving labor disputes stand out. Issues such as the need for balance between the autonomy of the parties and the protection of labor rights are explored. Access to arbitration is also analyzed, as well as legal security when using it, taking into account the existence of adequate legislation, the availability of qualified and impartial arbitrators, as well as procedural guarantees to ensure the effectiveness of arbitration decisions.
