Audiência de custódia prevista na Resolução 213/2015 do CNJ, e objeto do PLS 544/2011. As audiências de custódia referem-se ao procedimento de oitiva do preso em flagrante por uma autoridade judicial posteriormente à sua prisão. A referida Audiência consiste na apresentação do preso/custodiado à autoridade judicial competente dentro de um determinado lapso temporal, com o objetivo de análise de ocorrência da violação de algum direito previsto da Constituição Federal de 1988. Na referida Audiência, cabe ao juiz decidir sobre a legalidade da prisão, podendo conceder a liberdade ou, até mesmo, a imposição de uma medida cautelar, tal qual o arbitramento da fiança, entre outras medidas.
