Abstract

this article aims to analyze aspects of parental alienation, especially in cases of the practice of implanting false memories and untrue denunciations of intrafamilial sexual abuse. Thus, a study is carried out on the evolution of the family, the concept of parental alienation, the practices that characterize it, the differentiation of false memories and false accusations of sexual abuse, the consequences and possible violations resulting from these acts. In this regard, the problem of this article refers to discussing how acts of parental alienation can interfere in the formation of the individual and in the violation of rights enshrined by the legal system, in particular the very personal rights. For that, the methodology used was the literature review related to the theme, through the reading of consecrated works, as well as the analysis of several scientific articles and current legislation.

  • José sebastião de Oliveira, Unicesumar

    Possui graduação em Direito pela Universidade Estadual de Direito de Maringá (1973), mestrado em Direito Negocial pela Universidade Estadual de Londrina (1984), doutorado em Direito pela Pontifícia Universidade Católica de São Paulo (1999) e pós-doutorado em Direito pela Universidade de Lisboa (2013). Atualmente é professor da graduação e Pós-Graduação Stricto Sensu (mestrado e doutorado) do Centro Universitário de Maringá (UNICESUMAR). Membro do Conselho Nacional de Pesquisa e Pós-Graduação em Direito, sociedade científica do Direito no Brasil. Tem experiência na área do Direito, com ênfase em Direito Civil, atuando principalmente nos seguintes temas: direitos da personalidade, família, sucessões, responsabilidade civil e também em metodologia do ensino jurídico.
