LIMITES À LIBERDADE DE EXPRESSÃO EM RAZÃO DO HATE SPEECH: UMA REVISÃO DE LITERATURA

Resumen

Este artículo tiene como objetivo analizar el derecho fundamental a la libertad de expresión y la posibilidad de limitar el discurso de odio. De esta manera, se realiza un estudio sobre la conceptualización de la libertad de expresión hasta la sentencia del Supremo Tribunal Federal de hábeas corpus nº 82424-2, que representó significativamente en la protección de la dignidad humana en detrimento de los discursos discriminatorios. En este sentido, la cuestión de este artículo se refiere a la posibilidad de limitar el derecho a la libertad de expresión y si este derecho es absoluto, dado que la Constitución Federal lo ha declarado incensurable. Para ello, la metodología utilizada fue la revisión de literatura relacionada con el tema, a través de la lectura de obras de renombre, así como el análisis de varios artículos científicos, legislación vigente, análisis jurisprudencial principalmente en torno al estudio de caso del mencionado hábeas corpus.
