OVER-INDEBTEDNESS IN BRAZIL: LEGAL AND SOCIAL ANALYSIS AND THE PATHS TOWARD THE EFFECTIVENESS OF LAW Nº 14.181/2021

Over-indebtedness has become one of the main social and legal challenges in Brazil, affecting millions of consumers and undermining both household economies and human dignity. Law No. 14,181/2021 introduced mechanisms for the prevention and treatment of this phenomenon into the Consumer Protection Code. This article examines the effectiveness of the law from legal and social perspectives, discussing its progress, limitations, and practical obstacles. The research, qualitative and bibliographic in nature, draws on legal doctrine, recent court decisions, and data from CNC, Serasa, and IBGE. We conclude that the law’s effectiveness depends on financial education policies, institutional strengthening, and harmonization of case law. The law has the potential to foster financial citizenship, provided that practical and cultural barriers are overcome through coordinated action by the State, the market, and civil society.
