Abstract

This article aims to analyze domestic violence in Brazil, from 2020 to 2023, focusing on the crime of rape of vulnerable individuals during the COVID-19 pandemic. The research adopts a qualitative-quantitative approach, using literature review and document analysis, based on legal doctrine, scientific articles, jurisprudence, and relevant legislation. The study was structured around three axes: legal-conceptual foundations of domestic violence and rape of vulnerable individuals; analysis of the occurrence of this crime during the pandemic; and statistical examination of the registered notifications. The results indicate a high incidence of sexual violence against children and adolescents, with 44,987 cases between 2020 and 2021, corresponding to 74% of the occurrences. A higher concentration was observed among female victims in the 10–14-year age group (37.26%), while, among males, the 5–9-year age group stood out (5.15%). The home was the primary location where the abuse occurred (72%), and the perpetrators were mostly close family members (30%) and acquaintances (25%). It was also found that 44% of the cases involved repeated violence. In conclusion, the family environment can be a space of vulnerability, reinforcing the need for public policies aimed at protecting children and adolescents. This study contributes to the advancement of the legal and social debate on domestic sexual violence by demonstrating structural factors associated with its occurrence and supporting the formulation of more effective prevention and coping strategies.
