TYPES OF PRE-QUESTIONING ACCEPTED BY THE SUPREME COURT

The pre-questioning of the matter is one of the analysis criteria assessed in the admission of the Extraordinary Appeal by the Federal Supreme Court, which diverges from the Superior Court of Justice in relation to the admissibility of the Special Appeal, which can be observed in the Precedents issued by the Superior Courts, since the Supreme Court admits an Extraordinary Appeal where the matter has been pre-questioned, even if it has not actually been examined in the context of interlocutory appeals, while the Superior Court of Justice requires the matter to be examined by the referring body. For this reason, the technical study of this criterion, as well as its species conceived by the doctrine and accepted by the Supreme Court, is relevant.
