PATERNIDADE SOCIOAFETIVA:
ASPECTOS JURÍDICOS E SEUS REFLEXOS SUCESSÓRIOS

O presente artigo tem como obejtivo trazer uma análise acerca da paternidade socioafetiva e seus reflexos jurídicos e sucessórios no ordenamento jurídico brasileiro. A ideia é fazer um panorama, de maneira clara, de como se dá a sucessão nos casos em que um indivíduo possui dois pais, um por laços consaguíneos e outro por laços afetivos. Primeiramente, serão trazidos aspectos introdutórios sobre o tema, tais como conceitos, metodologia utilizada e as abordagens necessárias para melhor elucidação da problemática. A evolução do conceito de família e sua moderna concepção a luz da Constituição Federal de 1988 será o ponto de partida para o estudo. Logo após, será abordado sobre a parternidade socioafetiva, trazendo aspectos conceituais, como tem se dado abordagem contemporânea e a legitimidade da paternidade socioafetiva no tocante aos laços biológicos. Por fim, será debatido sobre a sucessão no que tange a paternidade socioafetiva e quais conclusões se pode ter com o presente estudo.
