Resumen

 Este artigo aborda os aspectos jurídicos no que tange à guarda de animais no fim do vínculo matrimonial. É abordada a concepção de família, a inserção dos animais no núcleo familiar e a consequência disso no momento em que ocorre a separação do casal, no divórcio ou na dissolução da união estável. Considerando questões como família, tutela, direitos matrimoniais e assistência aos animais, o estudo busca analisar a omissão do sistema jurídico brasileiro em relação à existência de uma lei que ampare os casais em processo de separação quanto a essa questão. Diante do alto índice de processos envolvendo a guarda de animais, o artigo busca, através da análise desses aspectos, promover discussões e propostas para regularização da guarda dos animais, trazendo à tona a hipótese de uma lei específica sobre o tema.
