A BANALIZAÇÃO DO DOLO EVENTUAL DO TRIBUNAL DO JURÍ: ENTRE A JUSTIÇA MIDIÁTICA E A SEGURANÇA JURÍDICA

O presente artigo analisa criticamente a crescente banalização do dolo eventual no âmbito do Tribunal do Júri brasileiro, especialmente em julgamentos marcados por forte comoção social e influência midiática. A pesquisa parte da hipótese de que, diante da pressão da opinião pública, os jurados tendem a aplicar de forma ampliada e imprecisa o conceito de dolo eventual, comprometendo a técnica jurídica e os princípios garantistas do Direito Penal. Com base em revisão bibliográfica e jurisprudencial, discute as distinções dogmáticas entre culpa consciente e dolo eventual, a interferência da mídia nos julgamentos populares e os riscos que essa tendência representa para a segurança jurídica. Conclui ser imprescindível reafirmar os princípios do Estado Democrático de Direito para garantir que o dolo eventual exerça sua função jurídica, sem se transformar em um meio de vingança social.
