ASPECTOS JURÍDICOS DO HOMICÍDIO FUNCIONAL PRATICADO CONTRA FILHO ADOTIVO

O estudo em tela almeja, com fundadas razões em entendimentos jurisprudenciais e doutrinários, analisar, a possibilidade de inclusão do filho adotivo como sujeito passivo no homicídio funcional, qualificadora que foi introduzida no Código Penal por meio do artigo 121, §2º, inciso VII. Fazendo uma justa interpretação do dispositivo legal à luz dos princípios da legalidade, que rege o direito penal, e da igualdade, que defende quaisquer distinções entre filhos adotivos e biológicos. Princípios estes, presentes na Constituição Federal, e imprescindíveis para que o estudo do reconhecimento do filho adotivo como possível sujeito passivo no texto do inciso VII seja feito de modo exato. Considerando ainda, os elevados números a respeito do crime aqui discutido. Deste modo, objetiva-se pautar os entendimentos contidos em jurisprudências e doutrinas correlatos ao tema a fim de buscar mais isonomia ao que diz a redação desta norma penal, visto que esta não incluiu os filhos supramencionados na figura legal, indo de confronto com os preceitos elencados na Magna Carta.
