ABANDONO AFETIVO INVERSO E A NECESSIDADE DE INCLUSÃO NO ROL DA EXCLUSÃO SUCESSÓRIA.

O presente trabalho busca discorrer sobre a necessidade e a possiblidade de inclusão do abandono afetivo inverso no rol taxativo da exclusão sucessória elencado no Código Civil Brasileiro de 2002, tendo em vista o crescente número de idosos no país. Ademais o crescente número de maus tratos e abandono contra idosos, muitas das vezes praticados por seus herdeiros necessários, como prevê a legislação brasileira. Sendo assim se torna completamente desvairado beneficiar com a herança o descendente que desampara o seu genitor na velhice, onde este necessita de maior amparo. A constituição federal de 1988 prevê que é dever da família o amparo aos idosos para que este tenha uma vida digna. O texto Constitucional também prevê o princípio da afetividade como de grande relevância nas relações familiares, uma vez, que na sociedade moderna possui grande valor na concepção das famílias. Também analisa o projeto de lei n° 3.145/2015 e o projeto de lei n° 229, de 2019 que visam a alteração do Código civil em relação a exclusão sucessória para as situações de abandono.
