DEVER FUNDAMENTAL DE OBEDIÊNCIA ÀS RESTRIÇÕES SANITÁRIAS IMPOSTAS PARA ENFRENTAMENTO DA PANDEMIA DA COVID-19
Abstract
The present paper intends to explore the imposition of sanitary restrictions during the Covid-19 pandemic in Brazil, as well as to recognize obedience to these restrictions as a fundamental duty of individuals in the face of the legal contours outlined by the Federal Constitution of 1988. uses bibliographical research as a method, referring to current legislation and events that occurred and were reported during the pandemic in the country. From then on, with the support of constitutional legal norms, especially those that aim to promote the protection of collective rights and those that allow state action that limits individual rights for the effectiveness of this protection, the work reaches its objective by being able to verify that, after the approach of necessary aspects such as state action and its legality and the reception of individuals to this action, the elements that make up the fundamental duties are present in the duty of obedience to the imposition of health restrictions to face the coronavirus pandemic, and that this duty of obedience constitutes an important instrument for reducing the effects caused by the disease and for the recovery of society as a whole.
