DEVER FUNDAMENTAL DE OBEDIÊNCIA ÀS RESTRIÇÕES SANITÁRIAS IMPOSTAS PARA ENFRENTAMENTO DA PANDEMIA DA COVID-19
Resumen
O presente artigo se dispõe a explorar a imposição de restrições sanitárias durante a pandemia da Covid-19 no Brasil, bem como reconhecer a obediência a essas restrições como dever fundamental dos indivíduos perante os contornos jurídicos traçados pela Constituição Federal de 1988. Para tanto, utiliza como método a pesquisa bibliográfica, referente à legislação vigente e aos eventos ocorridos e noticiados durante a pandemia no país. A partir de então, com apoio nas normas jurídicas constitucionais, sobretudo as que visam promover proteção dos direitos coletivos e as que permitem uma atuação estatal que limite direitos individuais para efetivação dessa proteção, o trabalho alcança seu objetivo ao conseguir verificar que, após a abordagem de aspectos necessários como a atuação estatal e sua legalidade e a recepção dos indivíduos a essa atuação, os elementos que compõe os deveres fundamentais estão presentes no dever de obediência às imposição das restrições sanitárias para enfrentamento da pandemia do coronavírus, e que esse dever de obediência constitui um importante instrumento para a redução dos efeitos provocados pela doença e para a recuperação de toda a sociedade.
