A APLICAÇÃO IMEDIATA DAS NORMAS DE EXECUÇÃO PENAL FRENTE AO PRINCÍPIO DA IRRETROATIVIDADE DA LEI PENAL

O artigo analisa as recentes alterações promovidas pela Lei nº. 14.843/2024 no âmbito da execução penal, com a finalidade de avaliar o princípio da legalidade e irretroatividade. Por meio de levantamento doutrinário e judicial, analisa se as novas regras estabelecidas para o instituto da saída temporária são de vigência imediata ou aplicados a todos os casos ou não. Verifica o entendimento dos tribunais superiores e da doutrina sobre o assunto. Demonstra que o princípio da legalidade deve ser ponderado em determinadas hipóteses. Conclui que o Supremo Tribunal Federal já tem precedente neste sentido, quando do julgamento da Ação Direta de Inconstitucionalidade por Omissão nº. 26.
