TIPOS DE PERÍCIAS MÉDICO-LEGAIS NO ABUSO E DEPENDÊNCIA DE SUBSTÂNCIAS

This article addresses the types of medico-legal expert examinations conducted in cases of psychoactive substance abuse and dependence, exploring their purposes and methodologies. The concepts of abuse and dependence according to current psychiatric classifications (DSM-5, ICD-11) and their implications in civil and criminal spheres are discussed, based on authors such as Genival Veloso França and Taborda. Expert examinations for the verification of acute use, assessment of causal links between substance use and specific events, and analysis of the capacity for understanding and self-determination are detailed. In cases of dependence, expert examinations for diagnosis, assessment of criminal responsibility, and psychic damage are explored. Forensic methodologies, including clinical examinations, toxicological tests (blood, urine, hair), and forensic psychiatric evaluations, are presented, along with inherent challenges such as the reliability of patient history, interpretation of tests, and comorbidities. Ethical considerations regarding confidentiality, impartiality, and stigmatization are also addressed, emphasizing the importance of qualified expertise for justice and public health.
