PUBLIC CALL AND NEW BIDDING LAW: LEGAL-DOGMATIC ANALYSIS OF COMPETITIVENESS IN PUBLIC PROCUREMENT

This study analyzes public calls for bids in the context of Law No. 14,133/2021, examining their legal basis, regulatory limits, and impacts on the competitiveness of public procurement. Based on a legal-dogmatic approach, the study investigates the role of public calls for bids as an instrument for implementing the principles of equality, transparency, efficiency, and obtaining the most advantageous results for the Public Administration. It seeks to understand the extent to which this form of selection increases the participation of suppliers, especially small and medium-sized ones, and contributes to the mitigation of practices that restrict competition. The methodology adopted consists of bibliographic and documentary research, with analysis of the applicable legislation, specialized doctrine, and relevant institutional positions. In conclusion, it is argued that, although public calls for bids represent a significant regulatory advance in the legal framework for public procurement, their effectiveness depends on strict compliance with objective criteria, adequate training of public managers, and the strengthening of control mechanisms, under penalty of compromising competitiveness and legal certainty.
