This Course Completion Work (TCC) addresses the topic of Legal Surrender in
Brazil, a legal provision that allows mothers or guardians to hand over their children
for adoption voluntarily and safely, protecting them from abandonment and illegal
abortion. Despite its relevance to the child protection system, Legal Surrender faces
challenges that limit its effectiveness, such as lack of information, social
stigmatization and institutional barriers. This study proposes to analyze the existing
gaps in the Brazilian adoption system that compromise the applicability and
accessibility of Legal Delivery, examining social, cultural and structural factors that
affect its implementation. The research adopts the development of case studies as a
methodology, seeking to identify the main difficulties and suggest measures to
strengthen this legal device. With this, the TCC aims to contribute to the debate on
improving the adoption system, promoting an approach that meets the best interests
of children and helps in the formulation of effective public policies.
