CIVIL CAPACITY OF PEOPLE WITH AUTISM SPECTRUM DISORDER AND THE CHALLENGES OF SUPPORTED DECISION-MAKING

A person's civil capacity is one of the pillars of the exercise of rights and duties within a society. However, for individuals with Autism Spectrum Disorder (ASD), this capacity can be interpreted differently, which raises relevant legal, social and psychological issues. The concept of supported decision-making emerges as an alternative to old approaches that treated people with disabilities as incapable, promoting greater autonomy. This article aims to analyze the civil capacity of people with ASD, discussing the legal implications and challenges of supported decision-making for this population. The research is conducted through a literature review, considering legal, psychological and social aspects that impact the lives of people with ASD.
