A INVISIBILIDADE DA VIOLÊNCIA: A FRAGILIDADE DA LEI AO TRATAR AGRESSÕES SEM LESÕES COMO CONTRAVENÇÃO PENAL

O texto aborda a violência doméstica contra a mulher, focando nas agressões sem lesões aparentes. Objetiva analisar a insuficiência da legislação atual e a necessidade de sua reformulação para garantir proteção efetiva às vítimas. Utiliza procedimento metodológico de análise legislativa e observação crítica dos efeitos jurídicos da tipificação atual. Identifica que o tratamento como contravenção penal minimiza a gravidade da violência e favorece a impunidade. Conclui que a revisão legislativa se mostra essencial para reconhecer a gravidade de todas as formas de violência doméstica e fortalecer os direitos fundamentais das mulheres.
