A LINGUAGEM JURÍDICA: A COMPREENSÃO E DECISÃO DO JÚRI

O Tribunal do Júri, instituição democrática consagrada na Constituição da República de 1988, enfrenta o desafio da incompreensão da linguagem jurídica pelos jurados leigos. Este artigo analisa os impactos da barreira linguística na compreensão e decisão dos jurados, com base em pesquisa teórico-empírica realizada na Comarca de Linhares-ES. A fundamentação teórica apoia-se em pesquisas que destacam o caráter constitutivo da linguagem no Direito. A pesquisa de campo, realizada com 20 jurados através de questionário estruturado, revelou que grande parte dos participantes compreendem "pouco" ou "muito pouco" dos termos jurídicos essenciais. Identificou-se correlação entre nível educacional e compreensão dos conceitos jurídicos. Com base nesses resultados, propõe-se um Protocolo de Mediação Linguística composto por três eixos: glossário jurídico acessível, sessão orientativa prévia e fortalecimento do papel pedagógico do juiz presidente. Conclui-se que a superação das barreiras linguísticas é condição essencial para a legitimidade dos veredictos e a efetiva soberania popular no Tribunal do Júri.
