A RESPONSABILIDADE CIVIL POR DANO SOCIAL DURANTE A PANDEMIA POR COVID-19

Comumente aplica-se a indenização por dano moral ou material diante do cenário da pandemia do Covid-19. Visto que a infração de um indivíduo atinge toda a coletividade, surge a necessidade de responsabilização em favor da sociedade. Como forma de suprir essa carência, realizou-se um estudo sobre a responsabilização civil por dano social diante do desrespeito às medidas sanitárias na pandemia do Coronavírus. O propósito foi apresentar um mecanismo de redução dos casos de desrespeito às normas de combate ao atingir a esfera patrimonial do indivíduo. O estudo foi realizado por análise de obras renomadas, artigos científicos e pesquisas de precedentes no sistema jurídico brasileiro. Devido o dano social ser tema relativamente novo, além de identificarmos a possibilidade de sua aplicação em casos concretos no desrespeito às medidas sanitárias, encontramos divergência quanto à destinação da indenização, porém, com forte sustentação na possibilidade da sua reversão para o tratamento de pessoas infectadas e também prevenção. Dessa forma, verificamos que os legitimados para propor a ação indenizatória são os mesmos para propor ação coletiva, os quais poderão fazê-la sem a exigência de efetiva contaminação de terceiros para configuração do dano, sendo indenizadas indiretamente por valor aplicado mediante analogia de demais institutos reparatórios.
