A PRIVATIZAÇÃO DO SISTEMA PRISIONAL BRASILEIRO COMO ALTERNATIVA À CRISE CARCERÁRIA

O Brasil vivencia um cenário de caos em seu sistema carcerário decorrente da existência de uma lacuna que não supre os problemas de superlotação, doenças enraizadas, abusos físicos e psicológicos, dentre outras mazelas. Diante da problemática, surge a necessidade de implementação de um sistema que garanta a proteção social ao tempo que ressocializa o preso e respeita os direitos humanos. Como forma de suprir essa carência, realizou-se um estudo sobre a privatização do sistema prisional brasileiro como alternativa à crise carcerária. O propósito foi apresentar um mecanismo que dê maior eficiência ao sistema prisional. O estudo foi realizado por análise de obras renomadas, artigos científicos e pesquisas de dados práticos do sistema prisional brasileiro. Após um breve histórico do sistema de penas e prisões, direcionou-se ao instituto da privatização, em que o Brasil adotou, primordialmente, a gestão mista, consolidando uma cooperação entre entidade privada e o Estado. Dessa forma, verificouse que mesmo com a existência de críticas, seja no aspecto jurídico, econômico, político ou ético, há possíveis soluções que demonstra ser, a privatização, um caminho em busca de uma ressocialização dos presidiários de forma mais efetiva.
