O presente artigo tem como principal objetivo fazer uma breve análise acerca da ação penal, no que tange seu conceito, classificação e suas principais características. Ademais, este artigo foi desenvolvido com base na utilização de pesquisa bibliográfica, sites na internet, outros artigos científicos. De início vale mencionar que ação penal corresponde meio judicial utilizado pelo ofendido para buscar a culpabilidade daquele que de fato tenha praticado o delito. A ação penal pode ser classificada de diversas formas, quais sejam: ação penal pública condicionada (à representação do ofendido ou requisição do Ministério da Justiça), ação penal pública incondicionada, privada exclusiva e personalíssima e privada subsidiária da pública. Dessa forma, será tratado neste trabalho acerca das peculiaridades presentes nas diversas espécies de ações, seus prazos, legitimados e quando ela poderá ou não ocorrer.
