Abstract

Em 10 de dezembro de 2021, quatro acusados pelo incêndio na boate Kiss que vitimou fatalmente 242 pessoas e deixou mais de 600 feridas - os sócios da boate Elissandro Spohr e Mauro Hoffmann, e o vocalista do programa e ex-produtores Marcelo dos Santos e Luciano Bonilha - foram condenados. Todavia, a condenação tão esperada, chegou com grandes reviravoltas que estão causando uma enorme motivação e diversos posicionamento na área jurídica. Neste diapasão, o presente artigo pretende abordar a constitucionalidade da pena aplicada, bem como sua previsão no Direito Pena. Quanto a metodologia, trata-se de uma revisão bibliográfica com busca na legislação e artigos que tangessem sobre o tema. Por fim, conclui-se que os entendimentos pessoais conflitantes com normas legais e/ou constitucionais, encontram-se habilitados a impor “seus direitos”, e exercer seu poder de forma irrestrita que só contribui para a discórdia e desacredita a justiça, muito menos no dano observado na pessoa que localiza o alvo - às vezes irreparável
