ANÁLISE DA APLICAÇÃO DA PUNIBILIDADE NOS CRIMES COMETIDOS POR PORTADORES DO TRANSTORNO DA PSICOPATIA NO BRASIL

O objetivo deste artigo é analisar os aspectos jurídicos dos crimes cometidos por doentes mentais, ou seja, pessoas cujo comportamento, caráter e sentimentos foram alterados por um transtorno de psicopatia, enfatizando os comportamentos realizados de forma brutal, e citando algumas inquietações midiáticas e sociais, conceituando a psicopatia e esclarecendo os pilares de sua classificação. Adiante busca-se esclarecer o conceito de crime, imputabilidade e culpabilidade no âmbito do direito penal, bem como a condenação e execução de doentes mentais no sistema penal brasileiro. Com base em pesquisa bibliográfica, uma vez que a conceituação e caracterização da doença mental dependiam da atuação doutrinária de especialistas e da análise da legislação aplicável por meio de consulta ao conteúdo jurídico literário e à consulta à jurisprudência, a pesquisa foi elaborada em termos de métodos dedutivos. Ao final do estudo, ficou claro que é preciso desenvolver normas para regular a punição das pessoas com a doença.
