CHALLENGES IN APPLYING BRAZILIAN CRIMINAL LEGISLATION TO PSYCHOPATHS

The following article aims to make the reader questions themselves and understand the need to make changes to the legal limbo that exists in Brazil, when establishing the penalty for transgressors with antisocial personality disorder, better known as psychopaths. Currently, there is no consensus on the applicability of penalties for these people. Since the concepts of mental illness and behavioral disorder were differentiated, these have not yet been any changes regarding differentiated sanctions for these individuals. Therefore, it is clear that the State needs to develop an adequate way to restrain those who do not care about the consequences of their actions. With this in mind, this topic was chosen due to the importance of discussing the punishment applicable to these agents, aiming for a fairer and more balanced society. Finally, the basis of the research is based on doctrines, studies by experts in the field, and legislation.
