LGPD: O DESAFIO DA APLICABILIDADE DA LEI GERAL DE PROTEÇÃO DE DADOS NAS EMPRESAS

O presente artigo visa discorrer sobre a Lei Geral de Proteção de Dados e seus impactos nas Empresas. Visto que, diante o marco do Direito Civil de 2002, recebendo mecanismos adotados e aplicando regras no meio digital tanto para titulares dos dados quanto para os prestadores de serviços terceirizados. Por conseguinte, este estudo foi desenvolvido com o objetivo de analisar, informar de sua responsabilidade civil sobre a Proteção dos Dados Pessoais na condição expressa dos titulares responsáveis. Também com finalidades representativas de: a importância legal dos tratamentos de dados pessoais, a análise crítica da vulnerabilidade dos dados, a responsabilidade civil por lesão dos agentes na LGPD e por fim, expor os princípios atinentes a proteção de dados dos titulares. Portanto, para a elaboração desta pesquisa foi utilizado como metodologia de pesquisa revisão bibliográfica de obras Publicadas por meio da Lei nº 13.709/2018, que dispõe e regulamenta sobre o tratamento de dados pessoais por pessoa natural ou jurídica de direito público ou privado com objetivo de proteger os direitos fundamentais de liberdade e de privacidade e o livre desenvolvimento da pessoa natural, assim, como dever de resguardar os titulares.
