O trabalho situa-se no âmbito da Psicologia Jurídica, objetivando discutir, por meio de pesquisa bibliográfica, a primeira infância no ambiente prisional; refletindo sobre as conseqüências da separação ou permanência da criança com a mãe encarcerada. Abordam-se os prejuízos no desenvolvimento infantil dos bebês, além das condições precárias a que estão subordinados. Ressalta-se, que no Brasil há somente um Centro de Referência à Gestante Encarcerada, funcionando dentro dos padrões previstos. É possível afirmar a necessidade de implantação de políticas públicas voltadas para a atual situação das mulheres e crianças nas unidades prisionais; bem como para o desrespeito ao princípio da dignidade da pessoa humana, aos direitos prescritos na lei de execução penal e no Estatuto da Criança e do Adolescente.
