THE EFFECTIVENESS OF DIGITAL INHERITANCE: CHALLENGES AND LEGAL SOLUTIONS FOR THE SUCCESSION OF VIRTUAL ASSETS

This study addresses digital inheritance, a contemporary challenge to Brazilian Succession Law, given the growing inclusion of virtual assets, such as cryptocurrencies and monetized accounts, in individuals' estates. The main objective was to analyze the effectiveness of the succession of virtual assets, identifying the major challenges and applicable legal solutions within the national legal framework. The study examined the normative conflicts among the Civil Code, the General Data Protection Law (LGPD), and the restrictive clauses found in digital platforms' terms of service. Employing the deductive method, based on bibliographic and documentary research, the work investigated the distinction between patrimonial digital assets (inheritable) and existential digital assets (non-transferable). It was concluded that, despite the legislative gap, the application of the digital will and the judicial balancing between the right to inherit and post-mortem privacy are crucial to ensuring security and effectiveness in the transmission of the digital legacy in Brazil.
