PATRIMONIAL AND CORPORATE VIOLENCE AGAINST WOMEN: INTERFACES BETWEEN CORPORATE LAW AND FAMILY LAW

This article examines patrimonial and corporate violence against women as a specific form of gender-based violence, investigating its interfaces with Corporate Law and Family Law. Drawing on an interdisciplinary approach that articulates feminist legal theory, corporate law, and family law, it analyzes how practices such as fraudulent concealment of corporate assets, simulated dissolution of companies, asset stripping of jointly-owned businesses, and the exclusion of women from the management of family enterprises constitute forms of patrimonial violence protected by the Maria da Penha Law (Law No. 11,340/2006). The article examines the treatment of this subject in Brazilian law, with emphasis on the protective mechanisms available in civil, corporate, and criminal spheres, and on the insufficiency of existing instruments to curb corporate patrimonial violence. Finally, interpretive and regulatory guidelines are proposed to improve the legal protection of women victims of patrimonial violence in business contexts.
