A EFETIVIDADE DO INQUÉRITO POLICIAL COMO INSTRUMENTO PARA ELUCIDAÇÃO DOS DELITOS

O presente artigo científico se trata de revisão bibliográfica e jurisprudencial, que tem por fim analisar como o inquérito policial pode ser um importante mecanismo na diminuição da criminalidade e na prevenção de delitos. Se destaca que, o inquérito policial se destina a instruir a propositura de uma ação penal, e a medida que se sobressair a sua função preservadora de inibir a instauração de um processo penal infundado, temerário, resguarda-se princípios e direitos fundamentais e evitando-se custos desnecessários para o Estado, além de contribuir para uma maior eficiência do sistema jurídico-criminal e consequentemente para a promoção de justiça e segurança pública. Desta forma, este estudo trará as principais definições doutrinárias e jurisprudências sobre a natureza jurídica do Inqúerito Policial, bem como fará uma análise de suas caracterísitcas e finalidades. Ainda neste trabalho serão demonstrados outros entendimentos doutrinários e posicionamentos jurisprudenciais, avaliando a importância e os resultados que o Inquérito Policial proporciona para a elucidação de fatos delituosos, bem como a observância de preceitos constitucionais.
