ALIENAÇÃO PARENTAL:
PROTEÇÃO OU VIOLAÇÃO DE DIREITOS? UMA REVISÃO DA LITERATURA

O presente artigo tem como principal objetivo abordar acerca da alienação parental, respondendo ao presente questionamento: Alienação parental: proteção ou violação de direitos? Para responder a tal questionamento, foram realizadas pesquisas bibliográficas, jurisprudenciais, legislações nacionais, artigos e monografias que trataram do tema. Foi possível observar através disso o quanto a sua prática pode gerar danos psicológicos irreversíveis aos menores. Estes, por sua vez, são sujeitos detentores de direitos fundamentais, devendo seus direitos serem preservados. Tais direitos podem ser encontrados na Constituição Federal de 1988, na Lei 10.406 de 2002 (Código Civil), na Lei de nº 8069 de 1990 (Estatuto da Criança e do Adolescente) e na Lei de nº 12.318 de 2010, que trata da alienação parental.
