This study addresses the visitation rights of non-custodial parents in cases of domestic violence, analyzing the criteria and challenges faced by the Judiciary in regulating this right, especially when it comes to protecting children and adolescents. Domestic violence, by its nature, affects family dynamics and necessitates balancing the right to family life with the protection of the offspring. The research aims to identify the criteria used by the Court of Justice in regulating visitation, as well as to reflect on the adequacy of these practices in light of the comprehensive protection provided for in Brazilian law. The methodology is based on a literature review and case law analysis, offering a critical and in-depth view of the topic. The study seeks to contribute to the academic and legal debate on reconciling visitation rights with the protection of children in contexts of domestic violence.
