DIREITO DOS PACIENTES TERMINAIS: LIMITES E POSSIBILIDADES DA ORTOTANÁSIA E EUTANÁSIA NO BRASIL

This scientific article aims to discuss the rights of terminally ill patients in light of the legal limits and
possibilities of orthotanasia and euthanasia in the Brazilian legal system. The analysis is based on a
qualitative and exploratory approach, based on a bibliographic and documentary review, addressing
the fundamental concepts, the bioethical principles involved, the current legislation and the ethical
and legal discussions on the end of life. In a context where advances in medicine allow for the artificial
prolongation of life, there is a need to discuss respect for human dignity, patient autonomy and the
right to die with dignity. It is concluded that orthotanasia finds greater legal and ethical acceptance in
Brazil, being supported by resolutions of the Federal Council of Medicine, while euthanasia is still
considered a crime, although it is constantly being debated in law and society.
