FASHION LAW COMO ESTRATÉGIA DE PROTEÇÃO ECRESCIMENTO DE MARCAS DE MODA: UMA ANÁLISEJURÍDICA A PARTIR DO CASO FARM RIO

O presente artigo analisa o Fashion Law sob a perspectiva do Direito Administrativo, destacando o papel do Estado na regulação, fiscalização e controle da indústria da moda, especialmente no que se refere à proteção da propriedade intelectual, à repressão de práticas ilícitas e à promoção do desenvolvimento sustentável. A pesquisa adota metodologia qualitativa, de caráter exploratório e bibliográfico, fundamentada em legislação nacional, doutrina especializada e dados institucionais do setor fashion. A partir do estudo de caso da marca FARM Rio, examina-se a atuação de órgãos administrativos, como o Instituto Nacional da Propriedade Industrial (INPI) e entidades reguladoras, evidenciando a relevância dos atos administrativos na tutela de direitos marcários e criativos. Analisa-se, ainda, o exercício do poder de polícia administrativa no combate à pirataria, à concorrência desleal e à publicidade enganosa, bem como a crescente intervenção estatal na agenda ESG, especialmente no enfrentamento do greenwashing. Conclui-se que o Direito Administrativo exerce função estruturante na organização da indústria da moda, assegurando equilíbrio concorrencial, proteção ao consumidor e segurança jurídica, além de atuar como instrumento essencial para o crescimento sustentável e a consolidação das marcas no cenário global.
