O presente artigo tem como escopo realizar uma análise acurada do assédio sexual contra as mulheres no ambiente de trabalho, bem como apresentar a evolução na legislação brasileira quanto aos crimes sexuais. Para tanto, foi necessário demonstrar como o Direito Penal há anos vem se ocupando de tipificar tais condutas, tanto para atender ao que preceitua a Constituição Federal, quanto para acompanhar a evolução da sociedade conforme os movimentos sociais de reconhecimento dos direitos das mulheres. Propõem-se, ainda, expor os conceitos de assédio moral e sexual e suas respectivas diferenciações doutrinárias, bem como, destacar as consequências psíquicas e sociais advindas do assédio sexual e os seus impactos nas relações de emprego, considerando, ainda a questão de gênero. Por fim, é mister apresentar a jurisprudência recente pertinente ao assunto.
