APONTAMENTOS SOBRE A (IN) APLICABILIDADE DA PROGRESSÃO DE REGIME PER SALTUM NO BRASIL

O presente artigo analisou a aplicação da progressão de regime per saltum ou por salto como instrumento necessário à garantia de direitos àqueles que são submetidos, notadamente, ao cumprimento de penas privativas de liberdade e não obtém do Estado o tratamento adequado. Para tanto, foi realizada pesquisa documental e bibliográfica, com o objetivo de explanar o tema de maneira precisa. Os resultados evidenciam que a superlotação carcerária é um dos principais fatores que retratam essa deficiência e que o Poder Executivo deve implementar políticas públicas adequadas para solucionar a crise estrutural enfrentada no sistema prisional brasileiro, a qual tem sido amenizada pela aplicação da progressão per saltum.
