DIREITO SUCESSÓRIO NA ADOÇÃO DE FATO

O presente artigo busca dissertar acerca da sucessão em âmbito da adoção, especificamente sobre o direito sucessório da adoção de fato. Sabe-se que, os filhos adotados ou biológicos não há distinção quanto aos direitos e deveres. Porém, a adoção, deve seguir critérios legais para ser válida. Nesse sentido, o Brasil é um país onde ainda há muita adoção de fato, ou seja, adoções que não seguem os critérios legais. Em detrimento, surgem vários embates, principalmente no que diz respeito à sucessão. Em suma, para tratar da sucessão na adoção de fato, é necessário se pautar no direito real, ou seja, analisar a situação fática e eliminar os conflitos de interesses.
