AS MODIFICAÇÕES LEGISLATIVAS NO CRIME DE INJÚRIA RACIAL E A LUTA CONTRA A DISCRIMINAÇÃO RACIAL

O presente estudo analisa as recentes alterações no Código Penal e na Lei 7.716/89, com relação ao delito de injúria racial. Trata-se de pesquisa bibliográfica, com análise da literatura preexistente, exposição e organização do quadro teórico sobre o objeto de estudo. Tem-se, ainda, pesquisa documental, com análise dos projetos de lei que resultaram nas mudanças legislativas. Após apresentação da metodologia utilizada, tem-se uma análise da distinção entre os crimes de injúria racial e racismo, destacando-se as mudanças relacionadas no campo legislativo referente ao primeiro delito. Em seguida, tem-se análise sobre a equiparação da injúria racial ao racismo dentro do contexto de luta contra a discriminação racial em nosso país. Por fim, discute-se sobre o uso do Direito Penal como instrumento de auxílio no combate à discriminação.
