CRIMES CONTRA OS ANIMAIS
REFLEXOS SOBRE A (IN) EFICÁCIA DA LEI DE CRIMES AMBIENTAIS

O presente artigo visa analisar a eficácia da Lei de Crimes Ambientais, com foco na proteção jurídica dos animais no Brasil, em especial no que tipifica os crimes de maus-tratos. A pesquisa discorre sobre o contexto histórico da legislação de proteção animal no país, até a inclusão de dispositivos mais específicos, a qual incluiu na Lei de Crimes Ambientais uma qualificadora de aumento de pena para crimes contra animais domésticos. Além disso, o estudo aborda a evolução da condição e participação dos animais na vida humana, incluindo apontamento sobre a senciência no Código Civil, e as principais dificuldades na aplicação da lei que obstam sua eficácia, incluindo o abrandamento das penas e a ausência de norma específica para o caso visando uma punição mais eficaz e preventiva contra os crimes.
