Do Reconhecimento da Paternidade Socioafetiva Post Mortem

O presente artigo tem o intuito de apresentar o tema da paternidade/maternidade socioafetiva post mortem e seus efeitos jurídicos. Haja vista que é comum na sociedade, principalmente nas famílias recompostas, a existência de vínculo afetivo entre padrasto e enteado ou entre madrasta e enteado, deve-se analisar os direitos oriundos dessa afetividade quando ocorre o falecimento de um dos membros. A nossa Carta Magna de 1988 e do Código Civil de 2002 estabelecem que não há distinção entre filhos, no entanto necessário se faz analisar a luz do direito como esse reconhecimento da afetividade ocorre post mortem. Deste modo, para desenvolvimento da problemática, utilizou-se da metodologia de pesquisa bibliográfica exploratória, buscando diversos entendimentos em doutrinas, jurisprudências, artigos e textos publicados dessa natureza. Mister se faz destacar a relevância do entendimento de alguns doutrinadores que foram basilares para o desenvolvimento da presente pesquisa como Maria Berenice Dias (2016), Clóvis Beviláqua (2000), dentre outros importantes precursores da temática.
