RESPONSABILIDAD DE LAS BIG TECH EN LA PROTECCIÓN DE LA INFANCIA, ANÁLISIS JURÍDICO DE LOS DEBERES DE CUIDADO DE LAS PLATAFORMAS DIGITALES FRENTE A LOS DERECHOS DE NIÑOS, NIÑAS Y ADOLESCENTES

El avance de las tecnologías digitales y la creciente presencia de niños, niñas y adolescentes en los
entornos virtuales han intensificado los debates jurídicos y académicos sobre la protección de la
infancia en internet. En este contexto, el presente estudio analiza la responsabilidad de las plataformas digitales en la protección de niños, niñas y adolescentes en el entorno digital,
considerando los desafíos relacionados con la seguridad digital, la circulación de contenidos
potencialmente perjudiciales y el papel de las empresas tecnológicas en la moderación de
contenidos y la gobernanza de las plataformas. El objetivo de la investigación fue examinar de qué
manera las big techs pueden ser responsabilizadas por la protección de usuarios vulnerables en el
ambiente digital, especialmente a la luz de los derechos fundamentales de la infancia.
Metodológicamente, se trata de una investigación de naturaleza cualitativa, desarrollada mediante
una revisión de literatura científica reciente sobre gobernanza digital, protección de menores en
internet y responsabilidad de las plataformas. Los resultados indican que la protección de la infancia
en el entorno digital depende del fortalecimiento de mecanismos regulatorios, del aumento de la
transparencia de los sistemas algorítmicos y de la implementación de políticas eficaces de
moderación de contenidos por parte de las plataformas digitales. Se concluye que la
responsabilidad de las empresas tecnológicas constituye un elemento central para la construcción
de entornos digitales más seguros, siendo necesaria la articulación entre regulación estatal,
gobernanza de plataformas y estrategias educativas orientadas al uso responsable de internet.
